Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and Distant Blue LLC ("Distant Blue," "we," "us"), a Delaware limited liability company, governing your access to and use of ORIZON1 and related services (the "Service"). By creating an account or using the Service, you agree to these Terms.
1.Acceptance of Terms
By accessing or using the Service, you represent that you are at least 18 years old and have the authority to enter into this agreement on your own behalf or on behalf of the organization you represent. If you do not agree to these Terms, do not use the Service.
2.Description of Service
ORIZON1 is a web-based software-as-a-service platform for generating, organizing, and exporting lighting controls documentation, including Controls Intent Narratives, Sequences of Operations, controls matrices, compliance checks, and related deliverables for use in the architecture, engineering, and construction industry.
The Service is offered in tiered subscription plans. Features, storage limits, and pricing for each tier are described on our pricing page and may change from time to time as described in Section 4.
3.Account Registration
To use the Service, you must register for an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You may not share your account with others or use a single account for multiple individuals. Notify us promptly at [email protected] if you suspect unauthorized access.
4.Subscription and Payment
Subscriptions are billed monthly or annually through our payment processor, Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. Subscriptions automatically renew at the end of each billing period at the then-current rate unless cancelled before renewal.
We may change subscription pricing from time to time. For existing subscribers, we will provide at least thirty (30) days' notice before any price change takes effect. You may cancel before the change takes effect if you do not wish to continue at the new rate.
All fees are exclusive of taxes, which you are responsible for paying where applicable. Fees are non-refundable except as described in our Refund & Cancellation policy below.
5.User Content and Data Ownership
You retain full ownership of all project data, content, and intellectual property you create, upload, or generate using the Service ("Your Content"). We claim no ownership over Your Content.
You grant Distant Blue a limited, non-exclusive, royalty-free license to store, process, transmit, and display Your Content solely to the extent necessary to provide the Service to you. You may export Your Content in standard formats at any time through in-app export functions.
6.Email Communications
By creating an account, you agree to receive transactional email communications necessary for the operation of the Service, including account notifications, billing receipts, security alerts, and material updates to these Terms. We will not send unsolicited marketing emails without your opt-in consent.
7.Limitation of Liability
To the fullest extent permitted by applicable law, Distant Blue and its members, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of or inability to use the Service, even if advised of the possibility of such damages.
Distant Blue's total cumulative liability to you for any claims arising under or related to these Terms shall not exceed the total fees paid by you to Distant Blue in the twelve (12) months preceding the event giving rise to the claim, or one hundred dollars ($100), whichever is greater.
8.Intellectual Property
The Service, including all underlying software, design, trademarks, documentation, and content provided by Distant Blue, is owned by Distant Blue and protected by applicable intellectual property laws. Except for the limited right to use the Service as expressly granted by these Terms, you receive no rights in or to the Service.
9.Termination
Either party may terminate this agreement at any time. You may cancel your subscription through your account settings or by contacting support. Upon termination, your right to access the Service ceases at the end of your current billing period. You may request a data export prior to termination by contacting [email protected]. Sections 5, 7, 8, and 10 survive termination.
10.Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved in the state or federal courts located in Delaware.

This Privacy Policy describes how Distant Blue LLC collects, uses, and shares information when you use ORIZON1 and our websites. We comply with the General Data Protection Regulation (GDPR) for users in the European Economic Area and the California Consumer Privacy Act (CCPA) for California residents.
1.Information We Collect
We collect the following categories of information:
- Account information — name, email address, firm or organization, and role, which you provide at registration.
- Billing information — payment method details, billing address, and transaction history, collected and processed by Stripe on our behalf. We do not store full payment card numbers.
- Project data — the content you create, upload, or generate using the Service, including project metadata, room configurations, device selections, and generated documents.
- Usage information — technical data such as IP address, browser type, pages visited, session duration, and feature usage, collected to operate and improve the Service.
2.How We Use Your Information
We use your information to provide, maintain, and improve the Service; process payments and send receipts; communicate with you about your account and the Service; detect, prevent, and address technical issues and abuse; and comply with legal obligations.
3.Third-Party Data Processors
We use carefully selected third-party service providers ("data processors") to operate the Service. These processors act on our behalf under contractual obligations that require them to protect your information.
- Stripe, Inc. — payment processing. Stripe receives your billing information when you subscribe. Stripe's privacy policy is available at stripe.com/privacy.
- Supabase, Inc. — database, authentication, and file storage infrastructure. Your account credentials and project data are stored in Supabase infrastructure. Supabase's privacy policy is available at supabase.com/privacy.
We do not sell your personal information to third parties, and we do not use your project data to train machine learning models or for any purpose other than operating the Service.
4.Data Retention
We retain your account information and project data for as long as your account remains active. If you delete your account, we will delete or anonymize your personal information within thirty (30) days, except where retention is required by law (for example, financial records for tax compliance).
5.Your Rights
Depending on your jurisdiction, you may have the following rights regarding your personal information:
- Access — request a copy of the personal information we hold about you.
- Rectification — request that we correct inaccurate or incomplete information.
- Erasure — request that we delete your personal information, subject to legal retention requirements.
- Portability — receive your data in a commonly used, machine-readable format.
- Objection — object to certain types of processing, including direct marketing.
- Withdrawal of consent — where processing is based on consent, withdraw that consent at any time.

6.Cookies and Tracking
We use essential cookies to maintain your session and keep you signed in. We do not use advertising cookies or third-party tracking pixels. We may use privacy-respecting analytics to understand aggregate usage patterns; no personally identifying information is shared with analytics providers.
7.Data Security
We implement reasonable technical and organizational measures to protect your personal information, including encryption in transit (TLS), encryption at rest for sensitive data, access controls, and regular security reviews. No system is perfectly secure, but we work to maintain industry-standard protections.
8.Children's Privacy
The Service is not directed to children under 18 and we do not knowingly collect personal information from children. If you believe a child has provided us with personal information, contact us and we will promptly delete it.
9.International Data Transfers
Your information may be processed and stored in the United States, where our infrastructure providers are located. For users in the European Economic Area, we rely on Standard Contractual Clauses and other lawful transfer mechanisms.
10.Changes to This Policy
We may update this Privacy Policy from time to time. For material changes, we will notify you by email or through the Service before the changes take effect. The "Effective" date at the top of this policy indicates when it was last updated.

We want you to get real value from ORIZON1. If something isn't working, reach out first — most issues can be resolved quickly. This policy describes the terms under which we issue refunds.
1.Subscription Cancellation
You may cancel your subscription at any time through your account settings or by contacting [email protected]. Cancellation takes effect at the end of your current billing period. You retain full access to the Service until that date.
2.Monthly Subscription Refunds
Monthly subscription fees are non-refundable. If you cancel a monthly subscription mid-cycle, you will not receive a prorated refund for the unused portion, but you will retain access until the end of the billing period.
3.Annual Subscription Refunds
Annual subscriptions include a fourteen (14) day money-back guarantee. If you cancel within fourteen days of your initial annual purchase, contact [email protected] and we will issue a full refund. After fourteen days, annual subscriptions are non-refundable.
4.Storage Add-Ons
Storage add-on purchases are one-time fees and are non-refundable once the storage has been allocated to your account.
5.Chargebacks
If you have a concern about a charge, please contact us at [email protected] before filing a chargeback with your bank or card issuer. Most billing questions can be resolved directly and faster than a chargeback process allows. Chargebacks filed without first attempting to resolve the issue with us may result in suspension or termination of your account.
6.How to Request a Refund
Send your refund request to [email protected] with the email address on your account and a brief description of the issue. Eligible refunds are typically processed within five to ten business days to the original payment method.

This Acceptable Use Policy sets expectations for how the Service may and may not be used. It protects our users, our systems, and the integrity of the documentation ORIZON1 produces.
1.Permitted Uses
You may use the Service for any legitimate professional purpose related to lighting controls documentation, including project specification, commissioning, compliance review, and training. Use within your own firm is permitted under the seat terms of your subscription.
2.Prohibited Activities
You agree not to:
- Share your account credentials or allow multiple individuals to use a single seat.
- Reverse engineer, decompile, or attempt to derive the source code of the Service, except to the extent such restriction is prohibited by applicable law.
- Circumvent or attempt to circumvent any access controls, usage limits, or billing mechanisms.
- Access or attempt to access other users' accounts, projects, or data without authorization.
- Use automated means (scrapers, bots) to access the Service outside of officially supported integrations.
- Use the Service to transmit viruses, malware, or any code intended to damage or disrupt systems.
- Use the Service for any unlawful purpose or to violate any applicable law or regulation.
- Use the Service to produce documentation you know to be false, misleading, or non-compliant for the purpose of deceiving reviewers, owners, or regulators.
- Resell or sublicense access to the Service without our written agreement.
3.Content Standards
You are responsible for all content you upload to or generate with the Service. You represent that you have the rights to use any content you upload (including third-party logos, photometric files, and project documentation) and that your use does not infringe on the rights of others.
4.Enforcement
We may investigate suspected violations of this policy and take appropriate action, which may include warning the user, suspending or terminating the account, removing offending content, or reporting the violation to law enforcement. We aim to give reasonable notice and opportunity to cure violations where practical, but we reserve the right to act immediately where a violation poses risk to the Service, other users, or third parties.
